What Is Section 504?
Section 504 of the Rehabilitation Act of 1973 is a federal civil rights law that protects students with disabilities from discrimination and supports equal access to educational programs and activities. Seattle Public Schools provides accommodations, aids, and services designed to meet the individual needs of students with disabilities as adequately as the needs of students without disabilities are met.
A student may qualify for Section 504 if they have a physical or mental impairment that substantially limits one or more major life activities, such as learning, reading, concentrating, thinking, communicating, walking, seeing, hearing, breathing, or caring for oneself.
How Do I Request a Section 504 Evaluation?
Step 1: Contact the School Building 504 Coordinator
Parents/guardians, school staff, or others with knowledge of the student may share concerns and request that the student be considered for a Section 504 evaluation. Families may email or contact the School Building 504 Coordinator listed above.
Helpful information to provide, if available:
- Concerns about how the student’s disability or suspected disability affects access to school
- Medical, health, or outside evaluation information
- Educational records or examples of school impact
- Any current supports or accommodations already being used
Step 2: School Based 504 Team Review
The School Based 504 Team reviews available information and determines whether an evaluation is needed. The team may gather information from parents/guardians, teachers, school staff, health care providers, and existing educational records.
Step 3: Evaluation and Eligibility Determination
If an evaluation is conducted, the School Based 504 Team reviews the information to determine whether the student has a disability under Section 504 and whether accommodations or services are needed for the student to access education.
Step 4: Development of a Section 504 Plan
If the student is found eligible, the School Based 504 Team develops a Section 504 Plan that identifies individualized accommodations and supports needed for equal access to education.
Parent Rights and Procedural Safeguards
Parents/guardians have rights under Section 504, including the right to participate in meetings, receive notice, review educational records, request an impartial hearing, and file complaints regarding Section 504 matters.
Life-Threatening Health Conditions
Students with life-threatening health conditions may qualify for Section 504 protections. Families may receive consent forms and procedural safeguards information as part of the SPS process.
